Stark Law Compliance

What is the Stark Law?  Who is covered by Stark?  Does it apply to all payers?  Are there exceptions?  Physicians in private practice are often presented with business opportunities that, in some cases, may not be legal. Do you have questions about the Stark Law?  Check here:

OB Providers

Drug testing of pregnant patients creates questions for OB providers.  What if the result is positive?  Do I need informed consent? Do I have to report my patient to law enforcement or child protective agencies?  JD HealthCare Partners, LLC has advised many OB practitioners with these and other topics.  Our experience enables us to provide workable solutions to support the operation of the clinic and minimize the risk to patients and the practice. Specific questions we have addressed are:

  1. Are you required to report a positive Urine Drug Test result for a pregnant patient?
  2. How should you document your medical record when a pregnant patient tests positive for an illicit or non-prescribed controlled substance?
  3. Is a signed informed consent required before performing a Urine Drug Test?

See our RESOURCES page under "OB Providers" for free downloadable resources and materials to help address these questions.

Across the United States, physician prescribing patterns are scrutinized by their licensing boards, state regulators, and Federal, state and local law enforcement.  The best defense is to prepare the practice to evidence the quality of care that is provided.  JD HealthCare Partners, LLC works with many pain management practitioners in the following areas:

  • Medical record reviews
  • Responding to licensing board investigations
  • Urine Drug Testing protocols
  • Risk management reviews
  • Financial relationships for designated health services
  • Policy and Procedure development
  • State and Federal standards for prescribing controlled substances
